1. Agreement to Terms

By visiting our web portal, submitting contact details, or utilizing any services supplied by NexGen Tech Solutions ("the Company"), you represent that you have read, understood, and agreed to remain bound by these Terms of Service. If you disagree with any terms, please discontinue access to the portal immediately.

2. Intellectual Property Rights

All custom digital codebases, UI structures, designs, graphic banners, vector assets, and brand identities displayed on this platform are owned by or licensed to NexGen Tech Solutions, protected under international copyright regulations.

Clients are awarded full ownership of custom-developed software components, web domains, and digital platforms only upon complete settlement of the respective project invoices as specified in signed service Level Agreements (SLAs).

3. Prohibited Activities

As a user or client of NexGen Tech Solutions, you explicitly promise to refrain from:

Interfering, modifying, or trying to compromise the security and routing frameworks of our servers or services.
Using our software platforms or digital marketing setups to disseminate spam, fraudulent communications, or unlawful advertising.
Scraping, copying, or reverse-engineering proprietary software architectures or operational strategies.

4. Limitation of Liability

NexGen Tech Solutions, its directors, developers, and digital marketing professionals shall not be held liable for any indirect, special, incidental, or consequential damages resulting from operational server downtime, loss of sales due to Google algorithm variations, or unexpected third-party platform updates.

Our cumulative legal liability for any formal claim or contract discrepancy shall never exceed the exact total amount paid by the client to NexGen Tech Solutions in the three (3) calendar months preceding the dispute date.

5. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New Mexico, United States of America, without regard to conflict of law principles. Any legal actions or proceedings shall be initiated exclusively in court systems located in Albuquerque, New Mexico.
